Terms and Conditions for Lone Peak Film Festival

1. Introduction

By accessing or using the Lone Peak Film Festival website (the “Site”) operated by Lone Peak Film Institute, a Montana-based 501(c)(3) nonprofit organization (“we,” “us,” “our”), you agree to comply with and be bound by these Terms and Conditions (“Terms”). If you disagree with any part of these Terms, you may not use the Site or participate in the Festival.

2. Definitions

  • “Festival”: The Lone Peak Film Festival, an annual event hosted by Lone Peak Film Institute.

  • “User”: Any individual or entity accessing the Site or participating in the Festival.

  • “Content”: All materials on the Site, including text, images, videos, and trademarks.
     

3. Intellectual Property

All Content on the Site, including films, logos, and branding, is owned by Lone Peak Film Institute or licensed to us. You may not reproduce, distribute, or modify any Content without prior written permission.

4. User Responsibilities

  • Film Submissions: By submitting films to the Festival, you grant us a non-exclusive license to screen, promote, and archive your work.

  • Conduct: Users agree not to engage in harassment, spam, or unlawful activities on the Site or during Festival events.

  • Age Restrictions: Users under 18 must have parental consent to submit films or purchase tickets.

5. Donations and Purchases

  • Tax-Deductible Donations: Contributions to Lone Peak Film Institute are tax-deductible to the extent permitted by law. Receipts will be provided.

  • Ticket Sales: All ticket purchases for Festival events are final. No refunds unless an event is canceled.

6. Third-Party Links

The Site may link to external websites. We are not responsible for the content or practices of third-party sites.

7. Limitation of Liability

Lone Peak Film Institute and Andrew Burrows are not liable for:

  • Technical errors, data loss, or interruptions to the Site.

  • Injuries, damages, or disputes arising from Festival events.

  • User-generated content or third-party actions.

 

Separate from Lone Peak Film Institute, Andrew Burrows, in his personal capacity as an individual, officer, director, employee, or affiliate of Lone Peak Film Institute, shall not be held liable for any claims, damages, losses, or legal issues arising from:

  • The use, interpretation, or enforcement of these Terms and Conditions, Privacy Policy, Cookies Policy, or any other legal documentation associated with the Site or Festival.

  • Technical errors, inaccuracies, omissions, or unauthorized access to the Site.

  • Violations of third-party rights, data breaches, or disputes related to user-generated content.

All liability for the Site, Festival, and associated operations rests solely with Lone Peak Film Institute, its governing board, and its authorized representatives.

8. Governing Law

These Terms are governed by Montana state law. Any disputes will be resolved in Montana courts.

9. Changes to Terms

We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance.
